Procedures to be followed by Rent Dispute Solving Committee Thursday, 14 October 2010 03:29

Cabinet Resolution No 37/2008, which specifies the procedures to be followed by the Rent Dispute Solving Committee.

 

 

Article 11

Committee members can hear more than one testimony in a session and if parties to a dispute become united, the Committee can issue a single decision for both.

 

Article 12

The Committee may write off the request if the requesting party or its representative did not attend the sessions determined by the Committee after certifying the summon to attend the first session.

The Committee shall have the right to continuum considering the request and decided it in the absence of the requesting party by itself or upon the litigant’s request.

 

Article 13

The Committee may decide the evidence of the requesting party’s waiver of the litigation upon its request unless the other party requests the continuation of the considering the dispute.

 

Article 14

The Committee may at any stage of the dispute consideration stages call the litigants to make a settlement of their dispute. If they responded, the committee may decide to stop the procedures for a period determined by the Committee. In the case they reached to a settlement of their dispute, the Committee will issue a decision of the settlement outcome agreed by the them and its decision shall be final.

In case of disagreement in the settlement, the Committee returns to consider the dispute from the stop point after determining a date for that. This date shall be notified to the dispute parties under receipt acknowledgement letter.

 

Article 15

No modifications, new applications or any documents or defence pleadings shall be submitted after keeping the request for decision unless the Committee declares for applying within limited date.

 

Article 16

Committee sessions shall be open and deliberations shall be secret. Committee decision shall be issued by the majority of members’ opinions with immediate execution.

The decision shall be in writing and signed by the chairman and members and shall include the following:

1. Names of chairman and members of the issuing Committee along with the place and date of issuance.

2. Names and capacities of the dispute parties.

3. Summary of dispute subject.

4. Litigants’ requests, pleadings and supporting documents.

5. Grounds and wording of the decision.

 

Article 17

The Committee decision regarding the subject matter of the dispute shall be issued within three months of the secretariat receipt of the settlement request. The Committee, for the reasons of dispute nature, may extend the period for an extra period totaled to maximum six months of the date of request receipt by the secretariat. The Committee may extend the time for the period required by the expert procedures.
