The said law also stipulates that it is permitted to grant work visa to the expatriate who had resided in the country for the purpose of work only after two years from the date of departure.

Applying this, we find that the inquirer’s sister did not get a residence permit and she departed Qatar before the end of the grace period, 90 days. Therefore, she can enter the country any time and she is not subject to the elapse of two years from the date of departure condition.

Labourers may work extra hours, provided that total actual working hours shall not be more than ten hours. The employer shall pay to the workers for the overtime at least the wage of ordinary working hours plus an excess of at least (25%) of this wage. Labourers who work between 9:00 pm and 3:00 am shall be paid their basic wage for the ordinary working hours plus at least (50%) of this wage with exclusion of shift labourers.

Moreover, the said Law states that the labourer shall be entitled to weekly paid rest of minimum consecutive 24 hours. Friday is the ordinary weekly rest day for all workers excluding shift labourers. If the work circumstance required, the labourers may be requested to work on the weekly holiday and the shall be entitled to another rest day and shall be paid for this day with the same wage of the rest day. Or they shall be paid their wages plus at least (150%) of the wage excluding the shift labourers. Labourers should not be requested to work for more than two consecutive Fridays.

Each labourer violates these regulations shall be fined with minimum two thousand riyals and up to five thousand riyals.

 

Question:A female employee working with a bank, whose foot has injured when she was on leave and she was under the treatment outside for three months and she got a certificate from the doctor outside in order to present it to the employer when she returns. She is asking about the sick leave in accordance with the Qatari LabourLaw, knowing that she did not recover after the surgery and she needs for a rest period if the law permits that.

 

Answer:

Employee’s sick leave shall be maximum three consecutive days for each leave and maximum ten working days yearly, if the granted period is more than the abovementioned one, the report shall be referred to the competent medical authority determined by the competent authority at the Health Affairs in the State to be approved.

Accordingly, the employee shall obtain a sick leave for maximum one year with the total salary. If the employee do not recover during this year, the competent medical authority may grants them a sick leave for maximum another year with half of the total salary. If the competent medical authority considers that the employee cannot be recovered and is no more able to work, the employee shall be referred to retirement due to their unfitness if the employee is Qatari and their service will be ended if the employee is not Qatari.

The said Law states that if the employee becomes sick when they are on a periodic leave or in an official duty, the employee shall get a medical report about his condition certified by the diplomatic mission, if any. The employee should present this report to the employer after returning back in order to be referred to the competent authority for approval.

Therefore, the inquirer should attest the medical certificate from the diplomatic mission at the USA and present it after returning to the employer to be referred to the competent medical authority for approval.

Answer: Law No. 8/18, concerning the regulation of commercial agents, states that the commercial agent is one authorized to distribute a certain merchandise or products, offer them for sale or circulation or provide certain services within the agency on behalf of the principal for consideration.

Agency contract stipulates that the agent shall be obliged to provide spare parts and make required maintenance for the merchandises and products included in the agency as required.

The Law also obliges the commercial agents and their agents to provide spare parts for consumers and prepare maintenance shops required for merchandises included in the agency with suitable prices.

Any one violating this shall be imprisoned for a maximum six months and fined with maximum ten thousand riyals or one of these penalties. In case of repeating this act, the maximum limit of penalty shall be duplicated. In addition, places of agency works may be closed without prejudice to any more severe penalty stipulated by any other law.

 

 

 

Someone is asking about the penalty against the commercial agent who does not have spare parts and required maintenance centres for the merchandise they distribute or the product offered for sale?
Human Resources Law No. 8/2009, concerning the sick leave, states that the employee, who stops the work due to sickness, shall refer the nearest health authority for examination and getting the required sick leave and they shall notify their employer.
Labour Law No 14/2004, concerning the regulation of work time to the maximum limit of ordinary working hours, which is 48 hours weekly of 8 hours a day in all months of the year, except Ramadan, 36 hours weekly of 6 hours a day. Working hours must include one period or more for prayer, rest and eating. These periods are not accounted as working hours. Rest periods shall be determined in proper way, provided that the labourer should not work more than five consecutive hours.
Some labourers are complaining that their company is making them work up to four hours extra time a day and the company is paying them for two hours overtime only. Is this legal? Is there a way to rectify the company’s mistake and oblige them to pay the full overtime to the labourer? And what are the overtime conditions?
Law No. 14/2009, concerning the expatiates entry, exit, residence and sponsorship, states that each expatriate coming for residence in the country shall have a residence permit and the sponsor shall be committed to complete the residence procedures and renewal procedures within maximum ninety days of its expiry.
A person says that his sister came to Qatar to work with a beauty saloon, but due to the sponsor’s circumstances, the sponsor decided not to contract with her and told her to search for another work under another sponsorship and she did not find work. After that, she departed Qatar after spending two months in Doha without stamping the residence visa in her passport. Currently, she has a new work offer in Qatar. He asks if she is permitted to enter the country again or she will have to least two years in order to enter the country again.

I hav worked in qatar for 3.5 years with a compny on work visa,now they cant find any new projects for me in qatar and have released me,but they wont giv noc,my wife is also working in qatar,i would like to stay in qatar and hav a family life,is there anyway i can work in qatar again......i think there should b some consideration given to our personnal lives,v r also human,v hav a desir liv wit our family life.....
I think someone should b tr who can help people like us who r suffering due to visa regulations........

i would to ask if there is regulation for the opening and closing of a store during Fridays? what should be the right time for closing and opening of a store during Fridays? is there a law that states that when your promoted to a higher position you cannot have an overtime pay? please answer this. thank you!
