Any person has the freedom to do something or to abstain from it. This matter is not absolute for the doctors. If a doctor declined to treat a patient, they will be responsible for the damage that may affect the patient, especially if the doctor is in a public hospital and that his duty is to treat patients inside the hospital.

If the doctor practises his work in the private clinic, they are not entitled to refrain from treating the patient if the patient’s condition is critical and they need the care of a doctor immediately, or if the patient is in a remote place and there is no other doctor to treat this patient.

Therefore, the Law urges doctors to take account of accuracy and honesty in all their actions and maintain the dignity and honour of the profession. Doctors should not be allowed to resort to illegal means and the relationship between them and the medical staff shall be based on mutual respect and close cooperation and to refrain in general from all what would demean the dignity of their colleagues and their of scientific, literary status or seeking illegally to replace positions in the treatment of patients and to avoid any action contrary to professional ethics.

Declaration of patient and doctor’s responsibility

Traditionally, doctors in private clinics or specialists in hospitals request the patients for the signing of a declaration agreeing to a surgical or medical examination.

The fact that the signing of the patient on this declaration does not exempt doctors from their responsibility for damage to the patient if it is proved that responsibility in accordance with the conditions and regulations referred to.

However, this declaration does not represent the only approval from the patient to treatment or surgery in a particular hospital or clinic-specific only, knowing that the patient’s consent and acceptance of a medical service is the tacit approval inferred from the health condition of the patient, which requires treatment.
