Article 1
The provisions of this law are applied to the traders and all business conducted by any person, even if he is not a trader.
Article 2
The provisions given in this Act or in any other laws relating to commercial matters are applied to the commercial matters. If there is no provision applied to the trade rule, then special and local rule will be preferred over general rule and if there is no trade rule, then the provisions of the Civil Code will be applied.
Article 3
The Business in general is the work performed by the person with the intention of speculation, even if he is not a businessman. The speculation predicts the profit by trading the transactions.
Article 4
The following works in particular are considered as business.
1. Purchase of goods and other movables, of whatever kind, in order to sell it, whether it was sold as it is or after being processed in another form.
2. Purchase of goods and other movable, whatsoever, for the purposes of leasing or renting it in order to re-lease the same.
3. Sale, or lease, or re-lease of goods purchased, or leased in the manner described above.
4. Buying the property, with a view to sell the same with its original state or after the division and sale of real estate bought for this purpose.
5. Establishment of commercial companies.
6. Contracts of works.
Article 5
The following works if performed professionally are considered as business:
1. Bank Transactions
2. Banking, financial transactions, investment and finance
3. Works of commercial agency and brokerage.
4. Supply Contracts
5. Work of general stores and mortgages on the funds deposited
6. Extractive operations of natural resources such as mines, quarries, oil, gas and others
7. Various types of insurance
8. Work and activity of the spots made for the general public such as public playgrounds, cinemas, hotels, restaurants and selling shops with auction
9. Work and activity of the role of education and private hospitals
10. Privileges of public utilities, such as distribution of water, electricity, gas, postal, telegraphic, telephonic and other communications
11. Transportation by land, sea and air
12. Maintenance, cleaning and other business services
13. Work agencies and offices of tourism, import, export, customs clearance and recruitment
14. Works related to printing, publishing, journalism, radio, television, transfer of news, photos, ads and sale of books
15. The industry if it was associated with an agricultural investment and the commitment to create and manufacture.
