Provision 97

If it was agreed that the price is the price of the market, then it is meant that it is the price of the market at the time and place in which the sale item must be delivered to the buyer. If there is no market at the place of delivery then it will be referred to the market price at the place which provides for custom that its prices are applicable.
Provision 98
If the contracting parties did not specify the price then the sale will take place with a price at which there has been the deal between them in past, if no deal took place between them in the past then the sale will be held at the market price and a different price will be adopted unless it gets clear from the circumstances or the commercial practice.
Provision 99
A third party may be authorized to determine the price. The market price on the day of sale will be adopted if the third party did not specify the price for any reason whatsoever. The competent court will determine the price if it was impossible to know the market price.
Provision 100
The net weight will be taken into account at the time of delivery if the price is estimated on the basis of weight unless otherwise both the parties agreed on other than that or there is a custom which is contrary to that.
The custom will determine the extent of mutual tolerance of defect in the goods because of transportation, or at the time of agreement on the delivery of a certain quantity approximately.
Provision 101
The law of compulsory pricing and its resolutions will not be applicable to the sales that already took place before it became effective even if the price is due at a later date.
The sales which took place during the effectiveness of these laws and resolutions then it is not allowed to exceed the specified price, otherwise it is permissible for the buyer to refrain from paying the extra amount or get back the amount, even if they had agreed on it.
The effects of sale ,Obligations of the seller
Provision 102
The sale will get nullified and the buyer will get his money back if the sold item perished before the delivery due to the reason in which the seller has no hand, but if the loss occurred after the buyer was warned to receive the sold item. The buyer has to pay the expenses if the seller took any necessary action to maintain the safety of the sold item.
Provision 103
If the value of the sold item decreased before the delivery due to the damage then the buyer may either request the annulment of the sale if deficiency was serious as if no sale contract was finalised or go with the sale with the reduced price.
Provision 104
If its export was made compulsory then the delivery will be completed when the sold item reaches the buyer unless there was an agreement which is contrary to that.
Provision 105
If it was agreed that delivery will be completed as soon as the sold item reaches the secretary of transportation. The liability of the loss will fall on the seller till the time of delivery of sold item to the secretary of transportation and then the same will be transported to the buyer.
