If the seller at the request of the buyer sent the sold item to an unspecified party then the liability of the loss will fall on the buyer from the time of the delivery of the sold item till it reaches the person who takes over its transportation. If the seller violated the buyer’s instructions regarding the mode of transport without any compulsion then he will be responsible for the damages caused by this violation.

If the sale took place on a deferred price, then the seller may stipulate a condition to transfer the ownership to the buyer after paying the entire price even though the sold item has been delivered.

The liability of the loss will fall on the buyer from the time of delivery.

If the deadline of delivery has not been specified then it is obliged to deliver as soon as the contract completes, unless the nature of the sold item or custom requires determining another date.

If the goods belong to a particular season then it is obliged to deliver the same before the end of the season.

If it was agreed that the buyer will set the date of delivery then the seller is committed to deliver in that period, taking into account what the custom and the nature of the sold item requires.

If the seller did not deliver in time, then the contract will be held unenforceable without the need to inform in advance, unless the buyer notified the seller about his determination to implement the contract within three days from the deadline. In this case the buyer has the right with the permission of the president of the court or without the permission in case of urgency, to buy at the expense of the seller the quantity in place of the sold item from the category agreed upon or a medium category in case of the absence of the agreement.

The buyer, with the good intention will use the right to purchase at the expense of the seller.

In the transactions in which the delivery of sold item is done in batches or stages, the buyer has right to ask for the termination of the contract if the seller did not deliver any batch or didn’t deliver the required item at some stages of time agreed upon. The annulment will not be applicable to the contract which has been implemented only if the division of the sold item results in harm to the buyer.

If the contract was terminated because of the seller’s failure to deliver on time, then the buyer has the right to ask the seller for the compensation with the difference between the agreed price and the price in effect in the market the day specified for delivery and without prejudice to the right of the buyer to claim compensation for the damages sustained as a result of the lack of implementation of the contract.
