Question: A person says that his son was hurt in a car accident when he was inside the compound where he lives. It clearly indicated the mistake of the car driver. He wants to know the procedures to report the incident. Doe the Qatari Law that protects from such incidents?

 

Answer:

The Penal Code No. 11/2004 also indicates that there shall be an imprisonment for a period not exceeding six months and a fine of not more than 1,000 Qatari riyals, or either of these punishments for a person who caused his mistake to the security of a person, whether it was caused by his negligence or lack of non-compliance with the laws or regulations. There shall be a punishment of imprisonment for a term not exceeding one year, and a fine not exceeding 5,000 (five thousand) Qatari riyals, or one of those penalties if the offence resulted in a permanent disability. In all cases the offender shall be punished by imprisonment for a term not exceeding two months if pardoned by the victim or his guardian.

It is evident from what has been mentioned that the most severe punishment has been provided by the Law No. 19/2007 as the term of imprisonment of not less than one month and not exceeding three years is the law applicable in this situation and after the occurrence of road accident, the traffic police shall be communicated. The police shall come to the place of accident in the case of an injury and appropriate means of aid shall be called then the report on the incident shall be written as well the offender shall be identified in accordance with the review. Then report shall be transferred to the prosecution and to the competent court to rule in the case. The victim has the right of the civilian prosecutor to demand the compensation for the damage he had suffered as a result of the accident, which shall be afforded by the driver and the insurance company solidarity if it is proved that the mistake led to the accident.

 

Question: An Asian woman who had been working as a maid for almost 20 years with the same employer went on vacation. But the sponsor decided to cancel her visa. Since she converted to Islam many years ago while working in Qatar it is difficult for her to live with her family in her native country. So she wants to return to Qatar again to search for a job. She wants to know how to get back again to work in Qatar and how long can she live outside the country to return once again to work for another sponsor?

 

Answer:

Therefore it is incumbent upon the questioner to ask the current sponsor not to prevent her from working with another sponsor so she can return to Qatar again with a work visa if she got the opportunity to work and that without the condition of spending two years out of the country from the date of departure.

It is worth mentioning that one can enter the State of Qatar once again by getting a visa other than the work visa as the proscription set forth by law is for the work visa only.

Whereas the expatriate can enter the country for a visit or business and other similar purposes for a period not exceeding 30 (thirty) days. It is not permitted for an expatriate to stay in the country after the expiry of the period referred to it only after renewing the same or obtaining residence visa.

The expatriate who has been allowed to enter or stay for a particular purpose or work in a specific department, must not act contrary to the purpose for which he was granted the permission. He must leave the country within 90 (ninety) days after the end of this purpose or work, or in case of cancellation of residence visa for any reason.

Law No. (4) for 2009 regulating the entry and exit of expatriates, their residence and sponsorship, answer to this question as it indicates that entry visa for the work shall be granted to the expatriate, who previously resided in the State of Qatar after two years from the date of departure. The interior minister or his deputy can waive this period. The competent authority may implement the sponsorship law to exclude some cases from that period on the basis of a written consent of the former sponsor.
There is no doubt that driving of cars and any kind of vehicles requires caution and care to preserve the lives and property of pedestrians and passengers. Therefore, the Traffic Law No. 19/2007 punishes the person who drives the vehicles on the road recklessly or exposing the lives of people and money to risk with the imprisonment for not less than one month and not exceeding three years and a fine of not less than 10,000 Qatari riyals and not exceeding 50,000 Qatari riyals, or either of them with no prejudice to any severer penalty provided for by another law.

I had road accident on the way to work due to driver mistake at Umsaieed, Qatar on March, 2009 with multiple fracture on both leg and went to India for treatment. After treatment I came back to qatar and submitted all my police, court verdict and Hamad medical & diaability reorts to company for my Insurance claim. Hence I request you to inform details about my claim.
