Provision 130

The provisions of the installment sale set forth in the preceding provisions will be applicable even if the contracting parties named it as rent.

Auction and sale with reduced prices in the shops (131-137)

Auction (131-131)

 

Provision 131

It is prohibited for the shops to their goods at auction only in the following cases and in order to obtain the necessary license from the competent authority:

1. To liquidate the commercial shop finally.

2. To leave the business finally in one kind or more in which the shop perform its business.

3. To liquidate one of the branches of the shop.

4. To liquidate goods that got defected because of a fire or leakage of water or moisture, or outbreak of insect or similar to that.

In all cases, the merchant must declare the reason for selling before a public auction.

To sell with reduced price (132-137)

 

Provision 132

Selling with the reduced prices is intended that the business firm announces about the sale of all or most of its goods at discounted prices for a limited period such as the sale by the seasonal liquidation or final liquidation or any other similar way which is announced to sell the goods with some reduced prices for a limited period whatever it has the name.

 

Provision 133

It is prohibited for the commercial shops to sell their goods at the reduced prices or advertise the same in any way, except after obtaining a permit from the competent authority.

 

Provision 134

It is permissible for the commercial shops to sell at the discounted prices with a view to the final liquidation for a single time only and for a period not exceeding three months in the following cases:

A – To discontinue the commercial activity.

B - Bankruptcy.

C - The death of the owner of the shop or any partner, if that resulted in the final liquidation of the business or stop of its activity.

D – To erase the record from the commercial register.

E – To change the type of commercial activity.

 

Provision 135

The competent ministry shall make the conditions for obtaining the license to conduct the sale at public auction and at the discounted price and it will place the rules and regulations which will be obligatory at the time of conducting such kind of sale.

 

Provision 136

The employees who have been authorized as the law enforcement officers by a resolution from the Attorney General with the agreement of the competent minister, shall record the violations in the shops that are selling the goods at auction and at the discounted prices and they are eligible to enter the shops, check the documents and bills and other securities and write the necessary irregularities.

 

Provision 137

Without prejudice to any severer penalty provided for by another law, anyone who violates the rules of the provisions contained in this section will be punished by an imprisonment for not less than one month and not exceeding one year and a fine of not less than 1,000 (one thousand) riyals and not exceeding 10,000 (ten thousand) riyals, or either of them, with the possibility of order to close the shop for a period not exceeding one month and the order to deprive the offender of the license set out in the provision (135) of this Act, for a period of three years from the date of the sentence referred to.
