The Law No. 4 / 2009 on regulating the entry and exit of expatriates, their residence and sponsorship, points out that the sponsor is committed to return the expatriate who is sponsored by him to his country at the end of his residence permit or its cancellation or issuance of a deportation order. If the expatriate refuses to leave the country in such cases, the sponsor has to notify the competent authority to deport him with the payment of the expenses of deportation. The sponsor is not committed to pay the expenses of deportation of the employee who is not subject to the Labour Law after thirty days from the date of notification of his escape. In all cases, the one who uses any expatriate on other’s sponsorship violating the provisions of the Sponsorship Act No 4 / 2009 is committed to pay the expenses of deportation, as well as the penalties prescribed by the law. The sponsor shall also bear the expenses of burial of the body of his deceased employee who had worked and he will be buried in the graveyards designated for that purpose in the State, whatever the cause of death. In the case of natural death, if any heir or any concerned party asked to send the dead body outside the state, the sponsor shall bear the transportation costs to the country of his origin or the permanent residence of his deceased employee. The Ministry of Interior may obligate the sponsor of the worker who is subject to the Labour Law to provide a bank guarantee in order to ensure the fulfillment of his obligations to the ministry and the sponsored employee. If the sponsor is a public servant and breaches his obligations towards his sponsored employee, the ministry may take the expenses of his deportation from his salary and dues in coordination with the party of his work.
