Provision 318
Trade representatives
The trade representative is one who has been commissioned by the merchant under a contract of employment, to carry out on behalf of the merchant the works that are related to his trade, whether travelling or in the shop of the merchant or anywhere else.
Provision 319
The merchant shall be responsible for the deals and contracts done by his trade representative within the limits of authority given to him by the merchant.
The trade representative may be authorized by several merchants and all shall be considered in solidarity with regard to the cases of recourse regarding the responsibility of the merchant for acts of his subordinates.
If the trade representative is authorized by a company, the company shall be responsible for his work.
Provision 320
If the limits of authorization have not been specified for the trade representative, the authorization shall be considered as inclusive of all transactions relating to the type of trade that has been authorized to be conducted by the representative.
The merchant cannot protest against the third party that contracts with the trade representative by limiting the authorization, unless the merchant proves the knowledge of others in this limitation.
Provision 321
The trade representative has to conduct the business which has been authorized in the name of the merchant who authorized him. The trade representative at the time of signing must mention the complete name of the merchant in addition to his full name along with his status as trade representative; otherwise he shall be responsible personally for what he did.
However, the third part in this case may recourse against the merchant directly, if the transactions done by the representative took place for the account of the merchant and they were related to the kind of trade authorized to do.
Provision 322
The trade representative has to represent the merchant in lawsuits arising from transactions carried out by him.
Provision 323
The trade representative cannot conduct a business for his account or the account of a third party, without obtaining a clear consent of the merchant, who he represents.
Provision 324
The travelling trade representative cannot take the price of the goods which he did not sell. He also cannot reduce its price or defer any price of the same. He must accept the requests of the others in the name of the person who he represents. He also must take the necessary measures to safeguard the rights of the person who he represents.
Provision 325
The merchant can authorize some of his employees for the sale in his store. He can take the sale price in the store, unless the payment is owed to the cashier. The sales receipts in the store shall be evidence on the merchant. The price can be required outside the store if the employees have been authorized in writing by the merchant.
Provision 326
The trade representative shall be liable jointly with the merchant for the observance of the legal provisions related to the unfair competition.

Brokerage
The brokerage is a contract whereby the broker undertakes for a person, against a fee, by searching for a second party to conclude a specific contract and he mediates to conclude the same with the conditions accepted by the person who authorized him to do so.
