Cabinet nod to set up new labour dispute committee

Prime Minister and Interior Minister H E Sheikh Abdullah bin Nasser bin Khalifa Al Thani chaired yesterday the Cabinet's regular weekly meeting at its Emiri Diwan premises.
After the meeting, the Deputy Prime Minister and Minister of State for Cabinet Affairs H E Ahmed bin Abdullah bin Zaid Al Mahmoud said that the Cabinet reviewed the topics on the agenda.
The Cabinet reviewed the programmes, plans and mechanisms set by the relevant ministries in implementation of the directives contained in the speech of the Emir at the opening of the regular 45th session of the Advisory Council.
The Cabinet took the necessary measures to issue a draft law amending some provisions of the Labour Law promulgated by Law No. (14) of 2004 and Law No. (13) of 1990 on the issuance of the civil and commercial procedures law, after the Cabinet reviewed the recommendation of the Advisory Council on the draft law.
A draft law was prepared in the framework of preserving labour rights and simplification of litigation procedures in labour disputes.
Under the amendment, one or more committees, to be called the "Labour Dispute Settlement" Committee, shall be established by the Ministry of Administrative Development, Labour and Social Affairs. They shall be headed by a judge of the Court of First Instance chosen by the Supreme Council of the Judiciary and two members nominated by the Minister with one them has experience in accounting.
The formation of the committee, its rules and the procedures, and the mechanism for implementing its decisions and their reward shall be issued by a decision of the Cabinet.
The committee shall be solely competent to adjudicate all individual disputes arising from the application of the provisions of this law or the contract of employment.
The committee shall decide on the dispute before it within three weeks from the date on which it is submitted.
Members of the committee shall be independent and have no authority over them in their decisions other than the law. No person or entity may intervene in the disputes considered by the committee.
Decisions of the committee shall be issued with accelerated access. Only the competent court of the Court of Appeal may order the suspension of the execution of its decisions.
After that, the Cabinet took the necessary measures to issue a draft law on domestic workers, after the Cabinet reviewed the recommendation of the Advisory Council on the draft law.
The draft law defines the rights and duties of employers and domestic workers.
The Cabinet approved the proposal of the Ministry of Economy and Commerce to extend the periods of adjustment in accordance with to the provisions of Law No. (20) of 2014 amending some provisions of the commercial register, and Law No. (5) of 2015 regarding similar commercial, industrial and general shops and street vendors and Law No. (11) of 2015 issuing the Commercial Companies Law.
The Cabinet also approved a draft decisions of the Minister of Public Health on the control of tobacco and its derivatives.
The Ministry of Public Health prepared these draft decisions in the framework of completing the necessary decisions to implement the provisions of Law No. (10) of 2016 on the control of tobacco and its derivatives.
The Cabinet approved an MoU for cooperation in agriculture with the Government of the State of Kuwait.
